The incident is from Gorakhpur, where a retired Border Security Force (BSF) jawan on Friday shot dead a 25-year-old youth with his licensed gun in front of the Civil Court Gate. It was accused of allegedly abducting and raping the minor daughter of the jawan in 2020.
The perished boy lived in Muzaffarpur, Bihar, and had come to court in rapport with a case. Then he was shot at the gate by the assailant and he died on the spot. The attacker has been caught by the two security guards present at the gate and the car parking manager.
After the incident, scores of lawyers moved to ascertain against the incident in Court.
Current ADG Akhil Kumar, while pacifying the protesters, has also convinced action on the security lapse in the court after investigating the incident.
It is noted in the reports that around 1.15 pm Dilshad Hussain (deceased) had called his lawyer Shankar Sharan Shukla to the civil court gate and before the lawyer could reach there, Bhagwat Nishad (girl’s father) ex-BSF jawan took out his licensed pistol and shot Dilshad in the head and immediately Dilshad fell on the ground and died on the spot.
Police said that “Police has assumed Bhagwat Nishad (accused) into custody. But, a case has not been enrolled against him previously.
Senior Superintendent of Police (SSP) Vipin Tada said, “A youth was shot died at the civil court gate and the assailant has been arrested. The body has been sent for post-mortem and after the statement comes. A case will be registered.”
According to the information, it has been learned that Dilshad Hussain (deceased) had a puncture repair shop in front of the house of Bhagwat Nishad (accused) in the Badhalganj area of the city.
In the case on February 12, 2020, the dead allegedly kidnapped the minor daughter of the accused. On February 17, the accused had filed a case of kidnapping, rape, and POCSO Act against her in court.
And on 12 March 2021, the police had arrested Dilshad in Hyderabad, also rescued the minor girl from him and Dilshad was sent to jail from where he was released on bail 2 months before.
According to ADG Akhil Kumar, ‘It should be investigated how the retired jawan entered the civil court premises with weapons. Action will be taken against whoever is found guilty during the inquiry. He also said that the accused has been caught with his weapon
As per the directions of the Supreme Court on matters related to sexual harassment, the identity of the victim is kept secret and hence not disclosed.
This incident has once again raised the question in front of the court that “why the death penalty is not given to the accused of rape?”

Is the judicial system so weak that a father was compelled to take such a big step to get justice for his daughter?
