A petition filed in the Kerala High Court challenges a government order restricting unvaccinated people’s access to shops and other establishments.

In India, Covid-19 cases are still rising and increasing every month for a year. Schools and colleges are closed. Everything is online nowadays. New variants are coming which have multiple infections and diseases that can affect a person differently this time. 

Now, to fight this battle against Covid-19, Our Indian Government released vaccines like covaxin and covishield which provide active acquired immunity to a certain infectious disease. Vaccination is not completely effective for everyone. There is some news which states that some proportionate of people who took both doses of vaccine died and some lived it up. So, it is not completely effective!! People still have doubts related to vaccines but as a process, if we have to live it up then we have to take up chances.

Recently, State Government made an order which states that “Only a person who has taken at least one dose of vaccine before two weeks, or who are having covid negative certificate taken 72 hours before will be allowed inside(workers/visitors) in shops, market, banks, public and private offices, financial institutions, factories, industrial establishment, open tourist places, and other establishments”.

This affects the right to life and privacy of the citizens of the country. Right to movement is the basic fundamental right of the citizen which shall not be violated, by restricting entry of unvaccinated persons to shops and other establishments, the right to life and movement will be violated which is against the law.

The petitioner lastly prayed that the order be suspended and allegedly unreasonable restrictions imposed on the unvaccinated are a violation of Articles 14,19 and 21 of the Constitution.
