Bail plea of six accused in Dilbar Negi’s death in connection with Delhi riots – Delhi High Court reserves order

Justice Subramaniam Prasad, after hearing the arguments of both sides (Delhi Police and the defense), Tahir, Shahrukh, Mohd. Faisal, Mohd. Shoaib, Rashid, and Parvez have been granted bail. These accused are accused of rioting and setting a sweet shop on fire by joining the mob of riots in North-East Delhi. Dilbar Negi, a 22-year-old boy, died of burns in this fire. He used to work as a waiter in Anil Sweet Corner.

Advocates who appeared for Delhi Police opposed this bail and said that since the riots started in the morning and continued till late at night, it cannot be said that the accused were involved in the mob of riots that took place in the afternoon, happened in the night Not in the crowd of riots.

Mahajan also said that “there is evidence that the accused were part of the mob that had rioted and that a person named Dilbar Negi had died due to their rioting. In such a situation, he should not be given bail and the accused did not even deny that he was not visible in the video footage in front of the shop. Whoever was part of the mob should be convicted under section 149.”

He also argued that “ the accused joined with 100 other rioters and their actions resulted in the death of someone, they could not say that we did not intend to kill.”

On the other hand, the defense defended their clients, saying that there was no evidence against them that they were involved in the charge of murder, so bail should be accepted.

In this case, a case has been registered against the accused under sections 147, 148, 149, 302, 201, 436, and 427 in the police station Gokalpuri. After the registration of the case, the local police investigated the matter and the further proceedings of the case have been transferred to the SIT of the Crime Branch. During the investigation 12 accused were arrested in the case and later the charge sheet was filed on 4th June 2020.

According to the statements given by the witnesses, it was told that there was a riot where the rioters involved pelted stones, raised anti-Hindu slogans, set fire to and ransacked several shops and houses, and entered a building where it was set on fire and the deceased was hiding there. and his body was burnt along with the building.
