‘Husband killed wife as being provoked, called him impotent’: Bombay High Court commute sentence of a husband accused of murder

The accused was given life imprisonment by the Bombay High Court for the murder of his wife, which the Bombay High Court has commuted to a jail term of 12 years. They say that the incident happened because of the sudden provocation of the husband by the wife. The husband had no such intention that he should kill his wife.

 A Division Bench of Justices Sadhna Jadhav and Prithviraj Chavan submitted:

Committed the sentence of the accused on the ground that when he committed the murder, the deceased wife accused the convict on a busy road and also called him impotent. The murder was not planned. He was severely provoked by his wife.

Details of the incident:

That day, when the husband was going out of the house, the deceased wife ran after her husband and started abusing him. She pulled his shirt and later called him impotent. Things got out of hand, and the convict could not control his anger, due to which he killed the deceased with a sickle.

Court proceedings:

Three witnesses, who were produced in the court, who were part of the family of the deceased said that it was an act of provocation. The counsel for the appellant without any objection requested the court to consider the same.

The appellant had argued that the incident took place due to the behavior of the deceased, as they had separated four years before the incident, and there was no relation between them as husband and wife.
